 1.0 Definitions

1.1. In these conditions, the following words have the following meanings:

The Customer: the person(s), firm or company who purchases the Goods from the Company;
The Company: Ice Cool Servicing Ltd;
Contract: any contract between the Company and the Customer for the sale and purchase of the Goods, incorporating these conditions;
Delivery Point: the place where delivery of the Goods is to take place under condition 4;
Goods: any goods agreed in the Contract to be supplied to the Customer by the Company (including any parts of them).

1.2. In these Conditions, references to any statute or statutory provision shall, unless the context otherwise requires, be construed as a reference to that statute or statutory provision as amended or replaced from time to time.

1.3. References to the masculine include the feminine and neuter; references to the singular include the plural and vice versa.

2.0 Use of this Website and Prices

2.1. The Company uses its best endeavours to ensure that the information on its website and publications is accurate and not misleading. Accordingly, the Company reserves the right to amend or delete product information without notice.

2.2. The Customer must supply a password when setting up a new account. The Customer is responsible for keeping this password secure and should not disclose it to third parties. Regular password changes are advised. The Company is not liable for any loss resulting from misuse of the Customer’s password.

2.3. The website information is intended solely for the Customer’s use. The Company does not authorise use of this information for any other purpose.

2.4. Prices are based on current costs and are exclusive of VAT, which will be added at the Checkout. Any changes in material or labour costs may be reflected in the final price.

3.0 Delivery

3.1. Orders placed before midday for in-stock goods are usually delivered the next working day on the UK mainland, though this is not guaranteed. Bulky or fragile items may take longer. Lead times may apply.

3.2. For offshore and remote areas (including Northern Ireland, Highlands, Isle of Man, Isle of Wight, Channel Islands, Alderney, and Scottish Islands), additional delivery costs may apply.

3.3. Product availability is subject to prior sales and cannot be guaranteed due to simultaneous order processing.

3.4. All delivery dates are estimates. Time is not of the essence.

3.5. Prices for large machinery, refrigeration, and flat-packed goods include UK mainland delivery to the ground floor door only. Delivery does not include stairs, unpacking, positioning, or assembly. The Customer must ensure items will fit into the premises. The Company is not liable if they do not fit. Costs for failed deliveries are the Customer’s responsibility.

3.6. The Company is not liable for any direct, indirect, or consequential loss arising from delivery delays, even if caused by its negligence.

3.7. Delivery delays do not entitle the Customer to cancel an order. The Company is not liable for delays caused by events beyond its control. Carriage fees are non-refundable.

3.8. Someone must be on-site to accept and sign for delivery. Any delivery signature is binding.

3.9. If the Customer fails to accept delivery or causes delays by not providing necessary information:

  • 3.9.1. Risk in the Goods passes to the Customer (including for loss or damage caused by the Company’s negligence);
  • 3.9.2. The Goods will be deemed delivered;
  • 3.9.3. The Company may store the Goods at the Customer’s cost (including storage and insurance);
  • 3.9.4. For large machinery or refrigeration, failed delivery due to Customer error may incur a re-delivery fee.

4.0 Returns

4.1. Goods are not supplied on a sale or return basis.

4.2. No returns are accepted after 30 days. Returns are at the sender’s cost and risk.

4.3. A returns authorisation reference must be obtained before returning items. Contact our office on 01869 247947 or complete the returns form.

4.4. Ice Cool Servicing Ltd reserves the right to charge an administration fee for returns. Large items may incur a restocking fee due to carriage and handling costs.

4.5. Order cancellations require Company approval. If accepted, a cancellation fee may apply.

4.6. Un required goods returned for credit must be in perfect condition and in original packaging. A 15% restocking charge applies.

4.7. Full purchase details, including order number, must be included with all returns. Equipment returns must include serial numbers.

4.8. Special items (non-stock lines and parts) are non-returnable.

5.0 Credit Terms

5.1. Credit terms are subject to approval and may be changed. Standard terms are 30 days end of month from invoice date. Ice Cool Servicing Ltd may charge interest on overdue accounts.

5.2. Product specifications may change due to continuous development.

5.3. Prices are subject to change without notice. All orders are subject to Ice Cool Servicing Ltd’s terms, and no other terms apply unless agreed in writing.

6.0 Retention of Title

6.1. Title to goods remains with the Company until full payment has been received for all goods supplied under any contract.

7.0 Guarantee and Liability

7.1. Goods supplied by Ice Cool Servicing Ltd are guaranteed in accordance with the manufacturer’s warranty (typically 2 years unless otherwise stated). This warranty applies to UK mainland only.

7.1.1. Goods are sold with a commercial warranty only. Ice Cool Servicing Ltd accepts no responsibility for goods used in domestic environments.

7.2. Warranty does not cover wear and tear, misuse, or lack of maintenance (e.g., cleaning, descaling). Repairs due to such issues are chargeable.

7.3. If machines sent for repair are not approved for repair, they will not be reassembled. Loan units are not provided.

7.4. Ice Cool Servicing Ltd accepts no liability for any loss resulting from representations, breach of contract, late delivery, negligence, or otherwise—except for death or personal injury caused by the Company’s negligence.

7.5. All warranties, conditions, and representations not expressly stated are excluded to the fullest extent permitted by law.

8.0 Damages and Shortages

8.1. Short or damaged deliveries must be reported in writing within 24 hours to allow for carrier claims.

8.2. If packaging is damaged, either reject the delivery or sign as “damaged.” Retain packaging and provide photos. Do not dispose of packaging before reporting.

9.0 Changes

9.1. Every effort is made to prevent errors in our publications and website. If an error is discovered, corrected details and prices will be confirmed at the time of order.

Finance Application Terms & Conditions

1. Finance Agreement Requirement

1.1. All finance-based orders are subject to approval by a third-party finance provider authorised and regulated by the Financial Conduct Authority (FCA).

1.2. By selecting to pay via finance, you agree to undergo a credit assessment and provide any required personal or business information necessary to process your application.

1.3. Ice Cool Servicing Ltd acts as an introducer and not a lender. All finance agreements are subject to the terms and conditions of the finance provider.

2. Order Confirmation & Delivery

2.1. Orders placed via finance will only be processed and confirmed once:

  • The finance provider has approved the application, and
  • All documents required by the finance provider have been signed and verified, and
  • Ice Cool Servicing Ltd has received formal notification from the finance provider that the agreement has been fulfilled.

2.2. Goods will not be dispatched or delivered until all of the above steps are completed.

2.3. Any estimated delivery dates provided prior to finance approval are indicative only and do not constitute a binding delivery timeline.

3. Non-Approval of Finance

3.1. If the finance application is declined by the finance provider, Ice Cool Servicing Ltd will notify you accordingly, and your order will be automatically cancelled unless an alternative payment method is arranged and approved.

3.2. In the event of a cancellation due to the finance refusal, no goods will be delivered, and no charges will be made unless you have chosen to proceed with an alternative method of payment.

4. Cancellation of Finance After Approval

4.1. If you cancel the finance agreement after it has been approved but before delivery of goods, a cancellation fee may apply to cover any costs incurred by Ice Cool Servicing Ltd, including administrative, handling, or restocking charges.

4.2. Goods may only be returned in accordance with our general Returns Policy, and finance-related returns must be coordinated through both Ice Cool Servicing Ltd and the finance provider.

5. Title and Ownership

5.1. Ownership of the goods remains with the finance provider until the finance agreement is settled in full, in line with the terms set out by that provider.

6. Delivery Responsibility

6.1. Once the finance agreement is confirmed and fulfilled, goods will be dispatched to the delivery address provided during the application process. It is the Customer’s responsibility to ensure someone is available to accept delivery.

6.2. Failed deliveries due to incorrect information or absence on-site may result in redelivery charges.

Service Plans Terms & Conditions

1. Introduction

These Terms & Conditions govern the subscription plans offered by Ice Cool Servicing (“Company”) for monthly ice machine servicing. By subscribing, you agree to these terms.

2. Service Plans

We offer three Plans:

  • Gold
  • Silver
  • Bronze

All Plans include:

  • Scheduled servicing visits per year – the number of visits is dependant on the service plan selected. Water filter, sanitiser and de-scaler are included in the price.
  • Discounts on parts and labour – the discount offered is dependant on the service plan selected.

3. Services Included

Each Service visit includes:

  • Cleaning and sanitising the ice machine.
  • Inspection of key components.
  • Water filter replacement.
  • Performance testing.

4. Discount Offers

Subscribers are entitled to:

  • Discount on replacement parts (specific discount percentage dependant on the service plan selected).
  • Discount on labour charges (specific discount percentage dependant on the service plan selected).

5. Plan Specification & Pricing

Plan price is dependant on the type of ice machine you have, and the level of cover selected.

6. Eligibility & Subscription

  • The Plans are available to all customers who register and agree to these Terms.
  • Subscriptions are valid for a minimum of 12 months term and will be recurring until 1 months notice is given.

7. Service Schedule & Changes

  • Service visits will be scheduled in advance.
  • The Company reserves the right to modify the schedule with prior notice.

8. Customer Responsibility

  • Ensure easy access to the ice machine during scheduled visits.
  • Inform the Company of any prior repairs or issues.

9. Termination & Refunds

  • Subscriptions can be terminated after a minimum term of 12 months, with one month notice.
  • Refunds are subject to the Company’s refund policy.

10. Limitation of Liability

  • The Company shall not be liable for any indirect, incidental, or consequential damages resulting from services.
  • The Company shall not be liable for any damages resulting from accidental or natural wear and tear during the provision of services.
  • The Company is not responsible for any damage caused by deliberate misuse, mishandling, or intentional damage to the ice machine by the customer or third parties.
  • Customers must ensure proper use and maintenance of the ice machine and follow provided guidelines.
  • Any damage resulting from unauthorised repairs, modifications, or misuse will be considered outside the scope of covered services and may incur additional charges.

11. Amendments

  • The Company reserves the right to amend these Terms & Conditions.
